Since 25 May 2018, the new European privacy law has been in force: the General Data Protection Regulation (AVG). The AVG extends individuals' right to privacy and imposes more obligations on organisations processing personal data. Citizens may access their data, have it amended or even completely erased. This does not apply if the personal data is processed for journalistic purposes only.

LogiNews is a journalistic medium and therefore has an exemption position within the AVG. We are regularly asked to remove personal data from previous publications. Based on our exception position, we do not comply with such requests. The rights that individuals have under the AVG therefore largely do not apply to LogiNews. If a journalistic article contains personal data such as a first and last name, for example, that person has:

• no right to oblivion: so there can be no request to remove the name;
• no right of withdrawal: in case of consent to publication, such consent cannot be withdrawn;
• no right to rectification;
• no right to inspect the processing of personal data by the medium in question;
• no right to object to the processing;
• no right to data portability to receive the personal data they hold from the medium.

The provisions on the supervisory authority are also exempt. This means that the Personal Data Authority does not have the power to supervise, nor can it impose fines for any breaches.
