Dutch
transport companies that hire drivers through a temporary employment agency or payroll organisation
and have them drive in Germany must still carry out the registration themselves in order to demonstrate to customs that the drivers are earning the German minimum wage.
It had previously been ruled
that these drivers had to be registered by the agency. Now, however,
the transport company is responsible for this after all. Dutch hauliers
must register both their own drivers and external drivers with the German
authorities. Two different forms are required for this.
Registration forms
Trade association
TLN provides a form on its website for registering its own
drivers and a form for registering agency and payroll drivers,
complete with guidance notes. It is important, however, that the agency or the
payroll organisation signs a declaration confirming that this driver earns the German
minimum wage.
